Nu samlar ett medborgarinitiativ in underskrifter f\u00f6r att kriminalisera l\u00f6nest\u00f6ld.<\/p>\n\n\n\n<p>Om arbetstagaren stj\u00e4l av sin arbetsgivare s\u00e5 kan arbetstagaren f\u00e5 sparken, men ocks\u00e5 bli polisanm\u00e4ld och d\u00f6md till b\u00f6ter eller rentav f\u00e4ngelse. Om det d\u00e4remot \u00e4r arbetsgivaren som stj\u00e4l av arbetstagaren, allts\u00e5 l\u00e5ter bli att betala arbetstagarens l\u00f6n helt eller delvis, s\u00e5 kan inte arbetsgivaren straffas f\u00f6r det. Arbetsgivaren kan s\u00e5 klart bli tvungen att betala den l\u00f6n som arbetstagaren oavsett skulle ha haft r\u00e4tt till, men n\u00e5got egentligt straff hotar inte.<\/p>\n\n\n\n<p>Det h\u00e4r missf\u00f6rh\u00e5llandet vill ett f\u00e4rskt <a href=\"https:\/\/www.kansalaisaloite.fi\/sv\/initiativ\/13689\" target=\"_blank\" rel=\"noreferrer noopener\">medborgarinitiativ<\/a> r\u00e4tta till. Enligt medborgarinitiativet borde strafflagen kompletteras med best\u00e4mmelser om l\u00f6nest\u00f6ld, grov l\u00f6nest\u00f6ld och l\u00f6nesnatteri. I de lindrigaste fallen skulle straffet vara b\u00f6ter, i de gr\u00f6vsta fallen f\u00e4ngelse i h\u00f6gst fyra \u00e5r.<\/p>\n\n\n\n<p>I allvarliga fall av arbetsrelaterat utnyttjande kan arbetsgivaren redan nu d\u00f6mas f\u00f6r till exempel ockerliknande diskriminering i arbetslivet eller m\u00e4nniskohandel. <strong>Paula Ilveskivi<\/strong> \u00e4r jurist p\u00e5 fackcentralen FFC och hon p\u00e5pekar att det ocks\u00e5 \u00e4r viktigt att ingripa i andra fall d\u00e4r arbetstagare utnyttjas.<\/p>\n\n\n\n<p>\u2013 Det m\u00e5ste bli stopp p\u00e5 att vissa f\u00f6retag har en aff\u00e4rsmodell som bygger p\u00e5 att de utnyttjar arbetstagare och str\u00e4var efter ekonomisk vinning p\u00e5 arbetstagarnas bekostnad. Om man inte g\u00f6r n\u00e5got \u00e5t de h\u00e4r fallen kommer arbetsgivarna att inse att det \u00e4r l\u00f6nsamt att utnyttja arbetstagarna och att det inte finns n\u00e5gon risk f\u00f6r att \u00e5ka fast. Det ger n\u00e4ring \u00e5t fenomenet och leder i v\u00e4rsta fall till fler fall av allvarligt utnyttjandet av arbetstagare, konstaterar Ilveskivi.<\/p>\n\n\n\n<p>FFC har l\u00e4nge kr\u00e4vt att till exempel l\u00f6nedumpning ska kriminaliseras. Det aktuella medborgarinitiativet \u00e4r ett annat s\u00e4tt att f\u00f6rs\u00f6ka ta itu med det h\u00e4r missf\u00f6rh\u00e5llandet.<\/p>\n\n\n\n<p><br><strong>I Norge har arbetsgivare redan d\u00f6mts f\u00f6r l\u00f6nest\u00f6ld<\/strong><\/p>\n\n\n\n<p>I Norge har l\u00f6nest\u00f6ld (<em>l\u00f8nnstyveri<\/em>) varit kriminaliserat i drygt tv\u00e5 \u00e5r. Det var fackf\u00f6rbunden som f\u00f6rst lyfte fram problemet, men h\u00f6gerregeringen under ledning av statsminister <strong>Erna Solberg<\/strong> tog tag i saken och drev igenom lag\u00e4ndringen. Det norska n\u00e4ringslivets centralorganisation NHO motsatte sig lag\u00e4ndringen.<\/p>\n\n\n\n<p>De nya paragraferna i den norska strafflagen tr\u00e4dde i kraft i januari 2022 och inneb\u00e4r att arbetsgivare kan d\u00f6mas till b\u00f6ter eller f\u00e4ngelse i h\u00f6gst tv\u00e5 \u00e5r f\u00f6r l\u00f6nest\u00f6ld, eller f\u00e4ngelse i h\u00f6gst sex \u00e5r f\u00f6r grov l\u00f6nest\u00f6ld.<\/p>\n\n\n\n<p><strong>Jonas Bals<\/strong> \u00e4r r\u00e5dgivare p\u00e5 den fackliga centralorganisationen LO i Norge och han konstaterar att facket ville att lag\u00e4ndringen skulle ge b\u00e4ttre m\u00f6jligheter att ingripa i l\u00f6nedumpning och social dumpning samt att polisen skulle g\u00f6ra mer i kampen mot arbetslivskriminalitet.<\/p>\n\n\n\n<p>\u2013 Vi \u00e4r glada \u00f6ver att best\u00e4mmelserna om l\u00f6nest\u00f6ld skrevs in i strafflagen, f\u00f6r att tydligg\u00f6ra att det \u00e4r en form av kriminalitet som ska behandlas p\u00e5 samma s\u00e4tt som andra former av st\u00f6ld. Vi var ocks\u00e5 skeptiska den tendens till klassr\u00e4ttvisa som finns i lagstiftningen, d\u00e4r anst\u00e4llda som stj\u00e4l av arbetsgivaren straffas h\u00e5rt, men d\u00e4r st\u00f6ld i andra riktningen kunde ske helt utan straff, s\u00e4ger Jonas Bals.<\/p>\n\n\n\n<p>I Norge f\u00f6ll den f\u00f6rsta domen f\u00f6r l\u00f6nest\u00f6ld h\u00f6sten 2023 n\u00e4r en restaurang\u00e4gare d\u00f6mdes till villkorligt f\u00e4ngelse i 30 dagar. Offret var en kvinna som hade jobbat som servit\u00f6r i tv\u00e5 \u00e5r och f\u00e5tt drygt 21 000 euro mindre i l\u00f6n \u00e4n vad hon borde ha f\u00e5tt enligt kollektivavtalet. Fallet uppdagades i en rutinkontroll som arbetarskyddsmyndigheten gjorde. F\u00f6rutom att restaurang\u00e4garen d\u00f6mdes till villkorligt f\u00e4ngelse, blev denne ocks\u00e5 tvungen att betala den uteblivna l\u00f6nen.<\/p>\n\n\n\n<p>Jonas Bals s\u00e4ger att LO fortfarande efterlyser en b\u00e4ttre framf\u00f6rh\u00e5llning i till\u00e4mpningen av de nya best\u00e4mmelserna i lagen. Dessutom vill LO st\u00e4rka arbetstagarnas m\u00f6jligheter att driva in den l\u00f6n de har blivit bestulna p\u00e5.<\/p>\n\n\n\n<p>\u2013 Straffaspekten \u00e4r ju bara en del av fr\u00e5gan.
